Larceny is defined as the taking of property, without consent of the owner, with the intent of depriving him or her of the value of the property taken. Degrees of theft include grand larceny or petty larceny, depending on the value of the property taken.

  • Petit larceny – Is the taking of property valued at less than $1,000; it is most often referred to as shoplifting. Since it is a Class A misdemeanor, it is punishable up to one year in jail, three years’ probation or a conditional discharge. If the property is damaged, the District Attorney’s Office will also seek restitution.
  • Grand larceny – Includes the unlawful taking of property, including credit cards or debit cards, with a value of $1,000 or more, or property taken directly from another person. Conviction can carry a prison sentence of one to four years (or more depending on the amount taken). The District Attorney’s Office will usually require restitution in order to get a better disposition.
