Larceny & Shoplifting

Larceny is defined as the taking of property, without consent of the owner, with the intent of depriving him or her of the value of the property taken. Degrees of theft include grand larceny or petty larceny, depending on the value of the property taken.

  • Petit larceny – Is the taking of property valued at less than $1,000; it is most often referred to as shoplifting. Since it is a Class A misdemeanor, it is punishable up to one year in jail, three years’ probation or a conditional discharge. If the property is damaged, the District Attorney’s Office will also seek restitution.
  • Grand larceny – Includes the unlawful taking of property, including credit cards or debit cards, with a value of $1,000 or more, or property taken directly from another person. Conviction can carry a prison sentence of one to four years (or more depending on the amount taken). The District Attorney’s Office will usually require restitution in order to get a better disposition.

Lawyers With The Experience You Need

The father/daughter team at Lerner & Lerner, P.C., has more than 50 years of combined legal experience. We have handled many cases involving theft, and we understand that there are a variety of reasons behind it. Oftentimes, life stress factors such as depression, mismanagement of prescribed medications or illness can be a factor. Stealing may also be a means to support an addiction to drugs or gambling. Or, it could simply be a one-time mistake.

We are compassionate, nonjudgmental, and will listen to you and help you make informed decisions. We will work to represent you as a person, and not just a number on the court’s calendar, allowing the judge to put a face to your name by providing character letters from people in your life who know that the action was not typical.
